License Agreement and Privacy Statement (En Español)

YOU EXPRESSLY AGREE THAT YOUR USE OF THIS APPLICATION IS AT YOUR OWN RISK.

NO EXPRESS OR IMPLIED WARRANTIES OF ANY KIND.

The application and all information, content, and materials included on or otherwise made available to you through this Application are provided to you through this Application are provided by the County of San Diego (“County”) on an “as-is” and “as available” basis.  The Technology used by ShakeReadySD is still in development and may occasionally provide alerts when no earthquake is occurring or fail to provide an alert when an earthquake occurs.

The County makes no representation or warranties of any kind express or implied, as to the operation of this Application or the accuracy of information, content, or materials included on or otherwise made available to you through this Application.

To the full extent permissible by law, the County disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

The County does not warrant that this Application information, content, or materials included on or otherwise made available to you through this Application are free of viruses or other harmful components.  The County will not be liable for any damages of any kind arising from the use of this Application from any information, content, or materials, included on or otherwise made available to you through this Application, including, but not limited to direct, indirect incidental, punitive, and consequential damages. 

The County and its officers, employees, and agents assume no legal liability for the accuracy, completeness, or usefulness of any information, product or process disclosed herein, or for any injuries or damages arising from any disaster or occurrence giving rise to the use or application of the information, products, or processes described or disclosed herein.  The County is making this Application available in furtherance of carrying out the provisions of the California Emergency Services Act and is immune from any liability associated with the use of the Application pursuant to Government Code Section 8655.

Except for the limited license granted in this Agreement, the County retains all right, title and interest in the Application and all proprietary rights in the Application, including copyrights and trademarks.  

PRIVACY

The County does not see, collect, or store any data you enter into the Application.  Any and all information you enter into the Application is stored on your device and not on the County’s website or server. Accordingly, the County is not responsible for any damages resulting from the loss or theft of that information.  Similarly, the County is not responsible or liable for loss, theft or misuse of any data that you choose to share, back up or store any location or service. 

 Only information intentionally sent to the County via email or similar contact form for the express purpose of contacting the County is accessible outside the Application.  In such cases, the County will not sell, rent or lease or otherwise disclose your personally identifiable information.  Information may be shared with entities that are contractually acting on behalf of the County.  Such entities are governed by similar policies with respect to the use of these data and are bound by the appropriate confidentiality agreements.  

CHARGES

While the County does not charge for the use of this Application, normal carrier data fees may apply. Please consult with your carrier to discuss any charges related to carrier data fees.

LIMITATION ON USE 

All use of the Application must be in accordance with these Terms of Use.  You may not:  (i) use any “deep link,” “page scrape,” “robot,” “spider,” or other automatic device, program, script, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy, or monitor any portion of the Application or in any way reproduce or circumvent the navigational structure or presentation of the Application to obtain or attempt to obtain any materials, documents, or information through any means not purposefully made available through the Application; (ii) attempt to gain unauthorized access to any portion or feature of the Application, including without limitation, the account of any other authorized user or any other systems or networks connected to the Application or to any server used by the County or to any of the services offered on or through the Application, by hacking, password “mining or any other illegitimate or prohibited means; (iii) probe, scan, or test the vulnerability of the Application or any network connected to the Application, or breach the security or authentication measures on the Application or any network connected to the Application; (iv) reverse look-up, trace, or seek to trace any information on any other authorized user of or visitor to the Application; (v) take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Application or systems or networks of the County or networks connected to the Application. (vi) use any device, software, or routine to interfere with the proper working of the Application, or with any other person’s use of the Application; (vii) use the Application to harvest or collect e-mail addresses or other contact information; or (viii) use the Application in an unlawful manner or in a manner that could damage, disparage, or otherwise negatively impact the County.  

NO ENDORSEMENT BY COUNTY

The County is a governmental entity and as such does not endorse any non-governmental entities.  You may not use this Application or any of the information in this Application to imply that the County endorses you or your organization. 

This Application may utilize various applications and services provided by your carrier or device.  The presence of these applications and services does not imply, and should not be interpreted as endorsement, sanction, approval, or authorization of these applications and service.  The County makes no guarantee or warranty, expressed or implied, concerning the functionality or accuracy of these applications and services.

The Application may contain hyperlinks to resources outside the County.  Links are selected to complement and extend services and information provided in this Application.  The presence of these links does not imply, and should not be interpreted as endorsement, sanction, approval or authorization of these sites or their content.  The County makes no guarantee or warranty, expressed or implied, concerning the content or accuracy of any material or any external website.  

MAPS

The County does use Google Maps and Mapbox on this Application.  The County does not endorse any non-Federal government entities or products.  The County is not responsible for any information collected by Google or Mapbox. 

EMERGENCY SERVICES

This Application should not be used to contact the County during an emergency. If you are in need of emergency assistance, please contact 9-1-1. If you are in need of emergency information, please contact 2-1-1. If you are interested in emergency preparedness, visit www.ReadySanDiego.org.

LICENSE AGREEMENT CHANGES; PUBLICATIONS STATEMENT

The Terms of Agreement for use of this Application are subject to change, without notice, upon public posting by the County.

COUNTY OF SAN DIEGO AND PERATON MAKE NO WARRANTY WITH RESPECT TO ANY TECHNOLOGY, GOODS, OR SERVICES USING THE DATA AND HEREBY DISCLAIMS ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
